By accessing, submitting, or purchasing any service, product, or content offered by Halftime Athletics through our official website, Google Forms, and/or our designated payment processor (Cash App), you, the undersigned, hereby acknowledge and agree to be fully bound by these Terms of Service. These terms constitute a legally binding agreement between you (the “User” or “Customer”) and Halftime Athletics, and govern all interactions, transactions, and use of services provided by Halftime Athletics. Please read these Terms of Service carefully, as they establish important legal rights and responsibilities. Should you disagree with any of the provisions set forth, you must refrain from engaging with Halftime Athletics’ services.

Halftime Athletics operates as a youth-led service and brand and is not formally registered as a business entity under any governmental authority. Therefore, these terms and conditions, while enforced to the fullest extent allowable by applicable law, are issued based on the understanding that Halftime Athletics is an initiative run by individuals who are under the age of majority. By continuing, you confirm that you understand the nature of this operation and accept the terms herein.

1. Scope of Services

Halftime Athletics provides athlete branding, promotional support, and media services, which include but are not limited to:

  • Logo Design and Branding

  • Website Setup and Maintenance

  • Social Media Exposure & Growth Strategy

  • Photography & Videography Services (Delaware-only)

The services provided are intended solely for the personal branding and promotional enhancement of athletes. Services are provided as-is, without guarantee of any specific outcomes such as scholarships, sponsorships, or financial success. Although Halftime Athletics is committed to providing high-quality service, we do not offer warranties or guarantees regarding third-party endorsements, exposure, or any external results.

2. Payment Method & Processing

Payments for all services are exclusively processed through Cash App. The sender must include their legal name in the Cash App note to ensure correct transaction identification. If the legal name provided does not match the information submitted via the form, Halftime Athletics reserves the right to withhold or cancel the service.

It is the sole responsibility of the User to ensure that all payment details are correct. Any failure to comply with payment instructions may result in service delays or cancellation without refund.

3. Refund Policy

ALL SALES ARE FINAL. Once Halftime Athletics has commenced any service, including, but not limited to, design drafts, media production, website setup, or consultation, no refunds will be issued.

  • Websites and Custom Domain Services: These are non-refundable once work has begun.

  • Service Initiation: As soon as any phase of the service is delivered (e.g., initial branding concepts, website drafts, or content delivery), no refunds will be processed.

  • Failure to Follow Instructions: Refunds will not be granted if the User fails to follow the instructions provided in the service request forms, including but not limited to:

    • Failure to provide a valid and functional contact method (email address, phone number, or verified Instagram handle).

    • Failure to include the correct legal name in the Cash App note at the time of payment.

    • Mismatch between the legal name provided in the payment and the form submission.

4. Responsibility of Minors and Parental Consent

Halftime Athletics welcomes users of all ages, including minors. However, any minor under the age of 18 must obtain consent from a parent or legal guardian to use Halftime Athletics' services unless the payment is made using the minor’s own independently obtained funds. If a minor uses an adult’s financial resources or payment method without express consent from the adult, Halftime Athletics shall not be liable for any consequences, and no refund will be issued once the service is delivered.

Parents or legal guardians are fully responsible for any purchases made by their minor children and assume all liability associated with such transactions. Should a child make a purchase using an adult’s funds or account, and Halftime Athletics delivers the service in good faith, the adult assumes all responsibility for the transaction and agrees that no refunds will be issued.

5. Service Delivery & Expectations

Halftime Athletics aims to provide the highest level of service and expertise to all customers. However, Halftime Athletics cannot guarantee any specific outcomes, such as increased social media followers, sponsorship deals, athletic recruitment, or professional contracts. While we are confident in the effectiveness of our services, we do not make promises regarding the achievement of specific goals. All services are provided as-is, and the success of any individual athlete is contingent upon various factors beyond Halftime Athletics' control.

Furthermore, Halftime Athletics is not responsible for any issues arising from the misuse of services, including any unintended consequences such as negative publicity or damage to reputation. All services are provided based on the information and materials provided by the athlete. Any failure to comply with our instructions or guidelines may result in service inefficiencies or failure to achieve the desired outcome.

6. Changes to Terms of Service

These Terms of Service may be revised or updated at any time without notice. By continuing to use Halftime Athletics' services after updates or modifications are made, you agree to be bound by the new terms. If you do not agree with the updated terms, you must cease using our services immediately. The most recent version of these terms will always be available for review on our website.

7. Liability Disclaimer

Halftime Athletics shall not be held liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use our services, nor shall we be liable for any unforeseen consequences of services delivered to a minor or any third-party interaction that results from our services. In no event will Halftime Athletics’ total liability exceed the total amount paid by the customer for the service provided.

8. Contact Information

By engaging with our services, you consent to receive communication from Halftime Athletics, including but not limited to email, direct messages, and promotional communications. If you wish to opt-out of receiving such messages, you may do so by notifying us through the provided contact methods.

9. Miscellaneous

  • Non-Refundable Purchases: All custom websites, domains, and digital content services are final sales and non-refundable.

  • Indemnification: You agree to indemnify and hold harmless Halftime Athletics, its agents, affiliates, and representatives from any claims, damages, or liabilities arising out of your use of our services or from any third-party actions related to your account.

By proceeding to engage with Halftime Athletics’ services or by making a purchase, you acknowledge that you have read, understood, and accepted all provisions outlined in these Terms of Service. These terms are legally enforceable under applicable law, and your engagement with Halftime Athletics is deemed to be a legal agreement between the user and Halftime Athletics.
